7.1
the seller guarantees that the vessel is to have a deadweight of not less than 11.500 metric tons at the design (summer loaded ) draft moulded of 8.0 meters in sea water of 1.025 specific gravity. the actual deadweight of the vessel expressed in metric tons shall be based on calculations made by the seller’s design company’s report and checked by the buyer, and all measurements necessary for such calculations shall be performed in the presence of the buyer's supervisors) or the ** authorized by the buyer.
7.2
should there be any dispute between the seller and the buyer in such calculations and/or measurements, the decision of the classification society shall be final.
7.3
insufficient deadweight
7.3.1 in the event that there is a deficiency in the actual deadweight of the vessel determined as provided in the specifications, the contract price shall not be decreased if such deficiency is two hundred and thirty (230) metric tons or less below the guaranteed deadweight of 11,500 metric tons at design draft of 8.0 meters
7.3.2
however, the contract price shall be decreased by the sum of united states dollars one thousand only (us$ 1000.-) for each full metric ton of such deficiency being more than two hundred thirty (230) metric tons.
7.3.3
in the event that there should be a deficiency in the vessel's actual deadweight which exceeds five hundred (500) metric tons below the guaranteed deadweight, the buyer may, at its option, reject the vessel and rescind this contract in

accordance with the provisions of article seven of this contract, or may accept the vessel with reduction the contract price in the maximum amount of united states dollars two hundred seventy thousand only (us$ 270,000.-)

the seller, for a period of twelve (12) months following delivery to the buyer of the vessel, shall guarantee and take any defects of the vessel and take responsibilty against any defects of for her hull and workmanship. but the seller should not take responsible for any failue
